Terms of use

These terms apply when you use CompKoala, create an account, or post or submit content to the site. By using CompKoala, you agree to these terms. They should be read together with our privacy notice and disclaimer.

What CompKoala is

CompKoala is an independently operated competition directory and hobby project for Australians.

In these terms, “CompKoala”, “we”, “us” and “our” refer to the operator of the CompKoala website.

CompKoala does not run, judge or award the competitions listed on the site, and we are not a party to your entry or any relationship between you and a competition promoter.

Each competition is governed by the promoter’s official terms and conditions. Those terms always take priority over information displayed on CompKoala.

Although we review listings before publishing them, a listing on CompKoala does not mean that we endorse, certify or guarantee a competition, promoter or prize. Competition details can also change after we list them.

You should check the promoter’s official competition page and terms before entering. See our disclaimer for more information.

Your account

You must be capable of agreeing to these terms.

If you are under 18, you should only use CompKoala with the permission and supervision of a parent or guardian. Individual competitions may also have their own age and eligibility requirements.

You must:

  • provide a valid email address and verify it;
  • keep your password and sign-in links secure;
  • tell us if you believe somebody has gained unauthorised access to your account;
  • maintain no more than one account unless we have agreed otherwise; and
  • not create another account to avoid a suspension, restriction or moderation action.

You are responsible for activity that you authorise through your account and for taking reasonable steps to keep your account secure.

Your username must not impersonate another person or organisation, infringe another person’s rights, or be unlawful, abusive or deliberately misleading. We may require you to change a username where reasonably necessary.

Submitting competitions

You may submit competitions for us to consider adding to CompKoala. Please submit the official or neutral competition link wherever possible.

Do not knowingly submit:

  • personal referral or invite links;
  • paid-entry raffles or lotteries;
  • gambling promotions;
  • cryptocurrency promotions;
  • fake or misleading competitions;
  • malicious or unsafe links; or
  • competitions that clearly fall outside the kinds of promotions CompKoala lists.

Submitting a competition does not guarantee that we will publish it.

We review submissions and may edit, combine, decline, update or remove them where we reasonably consider this appropriate for the operation, quality or safety of CompKoala.

Where we edit a submission, we may change formatting, categorisation or descriptive information but will try not to materially misrepresent the promoter’s competition.

Posts, replies and profile content

You may be able to submit suggestions, replies, profile images and other content. You must only post content that you have the right to share.

You retain any ownership rights you have in your content.

By submitting content to CompKoala, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format and otherwise use that content as reasonably necessary to operate, maintain and improve CompKoala.

For public posts such as suggestions and replies, this licence continues for as long as that content remains on CompKoala. Those posts may remain after you close your account and may be attributed to “Guest”, as explained in our privacy notice.

For content that is removed from public display, such as a profile image, our licence ends except to the extent temporary copies remain in backups, logs or records that we reasonably need to retain for security, legal or operational purposes.

Do not post content that is:

  • unlawful;
  • abusive, threatening or hateful;
  • sexually explicit;
  • defamatory;
  • knowingly false or misleading;
  • spam or unsolicited advertising;
  • invasive of another person’s privacy;
  • malicious or harmful; or
  • infringing another person’s copyright, trade mark or other rights.

The suggestion board rules also apply to content posted there.

Ideas and feedback

We welcome ideas about CompKoala. If you voluntarily suggest a feature, design, improvement or other idea, you understand that:

  • we may use, modify, develop or decide not to use the idea;
  • we do not have to pay you or credit you for using the idea;
  • somebody else may already have suggested, developed or independently created something similar; and
  • submitting an idea does not give you ownership of CompKoala or of any feature, design, code or other material we independently create.

You keep any rights you already have in material included in your submission.

If you do not want us to consider or potentially use an idea on this basis, please do not submit it.

CompKoala content and intellectual property

The CompKoala name, branding, original written content, software, site design, graphics and arrangement of the site are owned by or licensed to CompKoala and are protected by applicable intellectual property laws.

You may use the site normally for personal purposes. You must not reproduce, republish or commercially exploit substantial parts of CompKoala without permission, except where the law allows it.

Facts about competitions are not claimed by CompKoala merely because they appear in our directory.

Trade marks, logos, competition artwork and other material belonging to promoters or third parties remain the property of their respective owners.

Fair use of the site

You must not:

  • scrape, harvest, copy or republish substantial parts of the directory in bulk without permission;
  • use automated systems in a way that places unreasonable load on CompKoala;
  • attempt to bypass rate limits, security measures or access controls;
  • probe or interfere with the site, servers or accounts without authorisation;
  • use CompKoala to facilitate automated, fraudulent or bulk competition entries contrary to a promoter’s terms;
  • impersonate CompKoala, a competition promoter or another user; or
  • use the site in a way that is unlawful or intended to harm CompKoala or other users.

Normal use of search engines, accessibility tools and ordinary browser functionality is not prohibited by this section.

Moderation and suspension

We may remove or restrict content, limit site features, suspend an account or close an account where we reasonably believe this is necessary because:

  • these terms or applicable site rules have been breached;
  • the account or content creates a security, legal or safety risk;
  • the account is being used fraudulently or abusively;
  • the site’s operation is being disrupted; or
  • action is reasonably required to protect CompKoala, its users or third parties.

Where practical and appropriate, we will tell you why action has been taken. In serious cases, including suspected fraud, security abuse or unlawful activity, we may act without advance notice.

You can close your account at any time from Account settings. Some public contributions may remain after account deletion as described above and in our privacy notice.

Links and competitions operated by others

CompKoala contains links to websites operated by competition promoters and other third parties. We do not control those websites and are not responsible for their content, security, privacy practices, availability or conduct.

When you leave CompKoala, the third party’s own terms and privacy practices apply.

Your competition entry, any information you provide to a promoter, and any prize or dispute arising from a competition are matters between you and the promoter.

Availability and accuracy

We try to keep CompKoala useful and accurate, but competition information can change, expire or become incorrect without notice.

We do not guarantee that:

  • every listed competition is still available;
  • every detail displayed on CompKoala is complete or current;
  • a promoter will accept your entry;
  • you are eligible to enter a particular competition;
  • a competition will proceed as originally advertised;
  • a promoter will award or deliver a prize; or
  • CompKoala will always be available or free from errors.

Always check important details against the promoter’s official terms before entering.

Our liability

Nothing in these terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including any applicable rights under the Australian Consumer Law.

Subject to those rights, CompKoala is provided on an “as available” basis.

To the extent permitted by law, we are not responsible for loss caused by:

  • relying on competition information that has been changed by a promoter or third party;
  • the conduct, failure or insolvency of a competition promoter;
  • a promoter refusing or invalidating an entry;
  • a competition being cancelled, altered or withdrawn;
  • a prize not being supplied;
  • third-party websites, services or security incidents outside our reasonable control; or
  • interruptions to the availability of CompKoala.

Nothing in this section limits liability where it would be unlawful to do so.

Changes to CompKoala

We may change, add or remove features of CompKoala from time to time. We do not guarantee that a particular feature will always remain available.

Where reasonably possible, we will avoid removing access to user information without providing an appropriate opportunity to retrieve or manage it first.

Changes to these terms

We may update these terms when CompKoala, our practices or applicable laws change. The date at the top of this page shows when the terms were last updated.

If we make a material change that significantly affects members’ rights or obligations, we will provide reasonable notice through the site or another appropriate method.

Changes will apply from the stated effective date and will not retrospectively change rights or obligations that have already arisen unless the law permits or requires this.

If you continue using CompKoala after updated terms take effect, the updated terms will apply to your continued use of the site.

If part of these terms is invalid

If a provision of these terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Governing law

These terms are governed by the laws of Queensland, Australia. You and CompKoala submit to the jurisdiction of the courts of Queensland and any courts that may hear appeals from them.

Nothing in this section prevents you from exercising any rights you have under applicable Australian law.

If you have a question, complaint or concern about CompKoala or these terms, please use our contact form.
